Terms and Conditions

The terms on which LEVEL UP supplies electric vehicle charging services in South Africa.

1. Who we are

These Terms and Conditions govern your use of the LEVEL UP electric vehicle charging network, the LEVEL UP website at levelupev.co.za, and the LEVEL UP mobile application. In accordance with section 43 of the Electronic Communications and Transactions Act 25 of 2002, our details are:

By registering an account, starting a charging session, or otherwise using our services, you agree to these Terms.

2. Our services

LEVEL UP finances, installs, operates and maintains electric vehicle charging infrastructure at commercial properties across South Africa. We supply:

We supply a service — the delivery of electrical energy to your vehicle — rather than physical goods. Where we do supply goods, such as an RFID card, our Delivery Policy and Return Policy apply.

3. Registration and your account

Some services require an account. You agree to provide accurate information, keep your login credentials secure, and tell us promptly if you suspect unauthorised use. You are responsible for activity on your account until you notify us. You must be 18 or older, or have the consent of a parent or guardian.

4. Pricing and payment

Charging is billed per kilowatt-hour (kWh) of energy delivered. Rates differ by charge point, connector type and tariff, and are not fixed by these Terms.

The rate applicable to your session is displayed at the charge point and in the LEVEL UP app before the session begins. Current rates are also available on request from sales@levelupev.co.za. Prices are shown in South African Rand and include VAT at the standard rate.

We may change our rates at any time and without notice. The rate displayed to you, and accepted by you, at the moment a session begins is the rate that applies to that session — a change to our rates never affects a session already under way.

Payment is taken through our payment provider. We do not store your full card details. Your bank may place a temporary authorisation hold at the start of a session, which is reconciled against the actual energy delivered when the session ends.

Before you confirm a transaction you will have the opportunity to review the full details, correct any errors, and withdraw from the transaction, as required by section 43(5) of the ECT Act.

6. Availability

We monitor our network continuously and maintain it proactively, but we do not warrant that any charge point will be available, operational, or free of faults at any given time. Availability may be affected by maintenance, grid supply, load shedding, network connectivity, or circumstances beyond our control.

7. Liability

Nothing in these Terms limits any liability that cannot be limited by law, including under the Consumer Protection Act 68 of 2008.

Subject to that, LEVEL UP is not liable for indirect or consequential loss, loss of profit, or loss arising from a charge point being unavailable. We are not liable for damage to a vehicle unless it results from our negligence or from a defect in equipment we supplied. Our total liability arising from any charging session is limited to the amount you paid for that session.

8. Suspension and termination

We may suspend or close an account where we reasonably believe it is being used fraudulently, unlawfully, or in a way that damages our equipment or endangers others. You may close your account at any time, as set out in our Cancellation Policy.

9. Changes to these Terms

We may update these Terms from time to time. The current version is always published on this page with its effective date. Material changes affecting existing account holders will be communicated by email or in the app before they take effect.

10. Governing law

These Terms are governed by the laws of the Republic of South Africa. See our Governing Laws and Jurisdiction page for detail.
