Governing Laws and Jurisdiction

The law that governs your relationship with LEVEL UP, and where disputes are heard.

1. Governing law

These policies, and any agreement between you and LEVEL UP EV Charging Solutions, are governed by and interpreted in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.

2. Jurisdiction

You consent to the jurisdiction of the Magistrate's Court having jurisdiction over you in terms of section 45 of the Magistrates' Courts Act 32 of 1944, notwithstanding that the value of the matter may exceed that court's ordinary jurisdiction. We reserve the right to institute proceedings in the High Court of South Africa, Gauteng Local Division, Johannesburg.

4. Resolving a dispute

If something goes wrong, please contact us first — most issues are resolved quickly and directly.

  1. Contact us: email sales@levelupev.co.za or call 071 482 2785. We aim to acknowledge within two business days.
  2. Escalate internally: if you are not satisfied, ask for the matter to be escalated to management in writing.
  3. External bodies: you may refer a consumer complaint to the National Consumer Commission, or a data protection complaint to the Information Regulator.
  4. Legal proceedings: either party may approach the courts identified above.

5. Severability

If any provision of these policies is found to be invalid or unenforceable, that provision is severed and the remainder continues in full force.

6. No waiver

Our failure to enforce any right or provision does not waive that right or provision.

7. Whole agreement

These policies, together with any signed agreement between us, constitute the whole agreement between you and LEVEL UP in respect of their subject matter.
